Import and export inspection and quarantine measures for the supervision and administration of feed and feed additives administration of quality supervision, inspection and quarantine on February 23, 2009 Council meeting, are hereby promulgated and take effect on September 1, 2009.

Chapter I General provisions
First article for specification import and export feed and feed additives of test quarantine supervision management work, improve import and export feed and feed additives security level, protection animal and human health, according to People’s Republic of China inbound and outbound flora and fauna quarantine method and implementation regulations, and People’s Republic of China import and export merchandise test method and implementation regulations, and State on strengthened food, products security supervision management of special provides, related legal regulations provides, developed this approach.
Second apply to imports, exports and transit of feed and feed additives (hereinafter referred to as feed) and supervision of inspection and quarantine.
For feed uses of animals, plants and their products in accordance with the provisions of this regulation.
Drug feed additives do not apply these measures.
Third State administration of quality supervision, inspection and quarantine (hereinafter referred to as AQSIQ) unified management of national import and export inspection and quarantine of feeds, and supervision and management.
AQSIQ is located in local entry-exit inspection and quarantine institutions (hereinafter referred to as the inspection and quarantine agencies) responsible regional import and export inspection and quarantine of feeds, and supervision and management.
Chapter II risk management
Fourth State quality inspection administration risk management of import and export feeds, including on the basis of risk analysis, product risk classification for import and export feeds implemented, corporate classification, regulatory systems, risk monitoring, risk warnings and other measures under review.
Fifth inspection and quarantine authorities in accordance with the import and export feeds of product risk level, different inspection and quarantine mode and adjust dynamically.

Article eighth AQSIQ on import and export feeds implemented risk control, make import and export feeds annual risk monitoring plan and prepare annual monitoring reports. Bureau of inspection and quarantine with local characteristics to develop specific implementation plan and implementation.
Nineth State General Administration of quality supervision, inspection and quarantine found under the import and export of feed safety situation problem and related organizations informed of problems at home and abroad as well as domestic and foreign markets for feed safety, on the basis of risk analysis, risk warnings in time.
Chapter III import inspection and quarantine
Section I registration
Tenth AQSIQ to allow feed manufacturing enterprises to implement the registration system of the country or region, should come from the registration of import feed production enterprises abroad.
11th foreign production enterprises shall comply with the export laws and regulations of the country or region, and requirements related to the criteria, and meet with China’s relevant laws and regulations and standards of the equivalent requirements, after examination by the exporting country or region administrations recommended to the AQSIQ. References should include:
(A) corporate information: company name, address, and official approval number;
(B) registering the product information: registration name, main raw materials, use;
(C) official certification: demonstrate that the enterprise had recommended approval of the competent authorities, which allowed freely sold in the exporting country or region.
12th AQSIQ shall review the recommended materials.
Fail to pass the examination, notify the exporting country or region Department of correction.
Examination, after consultation with the exporting country or region authorities, State quality inspection Administration sent experts to the exporting country or region to review its feed safety regulatory system, and enterprises to carry out spot checks for application for registration. Checks do not meet the requirements of the enterprise will not be registered and will cause to the competent authorities of the exporting country or region; on the spot to meet the requirements of and other recommended companies not selected shall be registered and published on the official website of the State administration of quality supervision.
13th registration registration will be valid for 5 years.
Need an extension of foreign production enterprises, by the authorities in the exporting country or region to the AQSIQ prior to the expiry of 6 months extension. When necessary, the AQSIQ to sent experts to the exporting country or region for their retrospective review of feed safety regulatory system, and conduct random checks on application for extension of the overseas manufacturers, on the spot to meet the requirements and have not been conducted on extension of offshore production for other companies, registration of extension is 5 years.
Article 14th overseas production enterprises, changing the registered, either collapsed or the exporting country or region authorities revoked the production license, business license, the AQSIQ cancelled its registration.
Section II inspection and quarantine
15th-feed the need for quarantine of entry permits shall be in accordance with the relevant provisions for quarantine of entry permits.
16th article the owner or his agent must feed entry before or upon their arrival to the inspection and quarantine Agency inspection, inspection shall provide a certificate of origin, trade contracts, letters of credit, bills of lading, invoices and so on, and according to the different requirements to provide quarantine of entry permits, certificate of inspection and quarantine of the exporting country or region, of the certificate of registration of import feed or feed additives (copy).
17th inspection and quarantine authorities in accordance with the following requirements, inspection and quarantine on imported feed:
(A) the Chinese laws and regulations, the State compulsory standards prescribed by the General Administration of quality supervision, inspection and quarantine requirements;
(B) the bilateral agreements, protocols and memoranda;
(C) the provision in the quarantine of entry permit requirements.
18th inspection and quarantine agencies on-site inspection on imported feed in accordance with the following provisions:
(A) certificate of checking: checking documents with the names of the goods, quantity (weight), packaging, container number, production date, the exporting country or region, such as company name and registration number of matches;
(B) labels: labels comply with feed label national standards;
(C) the organoleptic check: packaging, container is intact, the expiry date, there is no spoilage, with or without carrying harmful organisms, there is no soil, animal carcasses, animal waste and other prohibited substances.
Article 19th of on-site inspection of any of the following circumstances, the inspection and quarantine issued the notice on inspection and quarantine treatment, by the owner or his agent under the supervision of inspection and quarantine institutions shall be returned or destroyed:
(A) the exporting country or region were not included in the list is allowed to be imported from countries or territories;
(B) the products from non-registered foreign manufacturers;
(C) from registered non-registered products of foreign manufacturers;
(D) goods to match the certificates;
(E) the label does not meet the standard and cannot be corrected;
(F) the expiry date or spoilage;
(VII) found that soil, animal carcasses and animal waste, quarantine pests, effective treatment is not possible.

21st inspection and quarantine institutions of foreign manufacturers from different categories of products in accordance with the relevant inspection and quarantine supervision mode sample,/sampling of voucher issued, send safety and health projects, laboratory testing.
Sent to laboratory testing by sampling of the goods shall be transported to the inspection and quarantine agency assigned storage areas in quarantine awaiting test results.
22nd as inspection and quarantine, inspection and quarantine authorities of the entry of goods inspection certificate shall be issued, and releases them.
Unqualified through inspection and quarantine, inspection and quarantine issued the quarantine notice, the owner or his agent under the supervision of inspection and quarantine institutions, disinfestation, returned or destroyed, passing the treatments are allowed to enter needs external claims, issued by the relevant certificate by the inspection and quarantine authority. Inspection and quarantine institutions shall feed unqualified information reported to the State administration of quality supervision inspection and quarantine.
23rd the owner or his agent does not make the inspection and quarantine agency entry of goods inspection certificate issued by the former, it may not transfer, sale and use of feed.
24th article import feed-to unload, port inspection and quarantine agencies shall discharge in writing of the results of inspection and quarantine and the handling of notifications in a timely manner others unloading at the port inspection and quarantine institutions; need external certificate, after the port of unloading, inspection and quarantine institutions are documented in the certificate.
Section III supervision and management
25th article feed should have labels on the packaging, labeling China feed labels shall conform to the national standards.
Bulk feed, importers shall, in place of inspection and quarantine institutions specified package and up to feed labels before making an entry, dispatching directly to the inspection and quarantine authorities specified production and processing enterprises for the production of fodder, from applied label.

26th inspection and quarantine for imported feed Enterprise (hereinafter importer) implementation management. Importers shall, before the first inspection or inspection to inspection and quarantine agencies provide a photocopy of the record.
The 27th article import enterprises should set up archives, record feed inspection number, name, quantity/weight, packing and exporting country or region, foreign exporters, overseas production company name and registration number, proof of the entry inspection and quarantine of goods, imported feed flows of information, records retention period shall be not less than 2 years.
28th inspection and quarantine agencies to periodically review the record import Enterprise archival, fail to pass the examination, be included in the list of record companies, on imports of feed tightened inspection and quarantine.
29th abroad for feed safety incidents involving imported fodder, informed the relevant mainland authorities or will appear in users ‘ complaints feed safety and health issues, the inspection and quarantine agencies shall carry out retrospective investigation, and handled in accordance with the relevant provisions of the State.
Imported feed listed in the preceding paragraph, may cause damage to animal and human health and safety, feed import enterprises should take the initiative to recall and report to the inspection and quarantine authorities. Importing enterprises do not perform duty of recall, inspection and quarantine institutions may order importers to recall and be included in the list of record companies.
The fourth chapter exit inspection and quarantine
Section I registration
30th national quality supervision and quarantine of export feed production enterprises implement a registration system, export feed should come from the registration of export manufacturers.
31st to apply for registration of the Enterprise shall comply with the following conditions:
(A) plant, processes, equipment, and facilities.
1. the address shall be carried out in industrial pollution sources, appropriate distance from the farms, slaughterhouses, residential;
2. plants, plant layout reasonable, production area separate from the living area, Office area;
3. process design, compliance with health and safety requirements;
4. commensurate with the productive capacity of plant, equipment and storage facilities;
5. harmful organisms (insects, birds, rodents, flies, warehousing) prevention and control facilities.
(B) commensurate with their product’s quality management agencies, and professional and technical personnel.
(C) has the capabilities that adapt health and safety control.
(Iv) management system.
1. post responsibility system;
2. staff training system;
3. health check system;
4. in accordance with the hazard analysis and critical control point (HACCP) principle to establish quality management systems, self test automation on the basis of risk analysis;
5. standard hygiene practices (SSOP);
6. raw material, packaging material supplier evaluation and inspection systems;
7. feed label management and product traceability systems;
8. waste, waste-water treatment systems;
9. customer complaint handling system;
10. the emergency management system of quality and safety.
(E) the AQSIQ as forage product category the export inspection and quarantine requirements.
Article 32nd export production enterprises shall provide the local inspection and Quarantine Bureau to apply for registration, and submit the following materials (one original and three copies):
(A) the inspection and quarantine of export feed production, processing and storage business registration application form;
(B) the business license (photocopy);
(C) the Organization code certificate (copy);
(D) Department in charge of national feed, review, production, product approval requirements, required to provide approved documentation;
(V) involving environmental protection, issued by the environmental protection departments above the county level are required to provide supporting documents;
(F) at its 31st (iv) compliance management system;
(G) the production process flow chart, and marked with the required process parameters (except those involving trade secrets);
(H) the plant layout and color photographs (including panorama of factory, factory gate, main equipment, laboratories, materials, packaging sites, libraries, places of sample storage sites, archives and other);
(I) the application for registration, list of products and raw materials.
Article 33rd, no the inspection and Quarantine Bureau shall review the application materials, under following circumstances within the 5th to accept or not to accept the decision and notify the applicant in writing:
(A) application errors that can be corrected on the spot, permit the applicant to be corrected on the spot;
(B) the application documents are incomplete or do not comply with the statutory format, shall, on the spot or within the 5th time inform all applicants need to supplement in writing content, fails to inform the, shall be accepted as of the date of receipt of the application materials;
(C) the application materials are complete and comply with the statutory format or make corrections in accordance with the requirements to submit all application materials by the applicant, shall accept the application.
Article 34th, no the inspection and Quarantine Bureau should review group in the 10th after receiving such an application, export manufacturers on application for registration for site assessment.
35th review group shall upon completion of the site assessment review reports to the Bureau of inspection and quarantine in a timely manner.
Immediate inspection and quarantine upon receipt of the evaluation report of the 36th and 10th, respectively, made the following decision:
(A) passing the review, be registered and issued the inspection and quarantine of export feed production, processing and storage business registration certificate (hereinafter certificate of incorporation), from the date of making registration decisions in the 10th, and served on the applicant;
(B) reviewing nonconformities, issued by the inspection and quarantine of export feed production, processing and storage business of notice of registration has not been approved.
37th article of the entry into force from the date of issue of the registration certificate, valid for 5 years.
Belonging to the same enterprise, located in different places, with separate production lines and quality management system of export production enterprises shall apply for registration.
Each registered export manufacturers use a registration number. Export production enterprise registration number of registered plant-specific.
Article 38th export production enterprise changes its corporate name, legal representative, product varieties, production capacity, should change to the local inspection and Quarantine Bureau in the 30th after a written application, fill in the inspection and quarantine of export feed production, processing and storage business registration application form and submit information on this change (one original and three copies).
Change of company name, legal representative, upon review of the information by the inspection and Quarantine Bureau, directly change procedures.
Change of product or production capacity, organized by the Bureau of inspection and quarantine administrations under review relevant information and site assessment, after passing the review, go through the procedures of alteration.
Relocation of enterprises, should be re-registered with the inspection and Quarantine Bureau to apply for registration.
By layoffs, production, closures and other reasons is no longer engaged in the export of feed business shall be made to the local inspection and Quarantine Bureau for cancellation procedures.
39th were registered with the export production enterprise needs to extend the validity of the registration, shall be made in accordance with these regulations before the expiry of 3 months applies.
40th inspection and Quarantine Bureau shall after the completion of registration, change or cancellation of the work in the 30th, the information reported to the State administration of quality supervision record.
41st article import from countries or regions require registration of export production enterprise list, after examination by the local inspection and Quarantine Bureau, and reported to the State administration of quality supervision. AQSIQ organized spot check assessment, consolidated authorities recommend to importing countries or regions and in the relevant procedures.
Section II inspection and quarantine
42nd the inspection and quarantine of export feed inspection and quarantine institutions in accordance with the following requirements:
(A) the inspection and quarantine requirements in the importing country or area;
(B) the bilateral agreements, protocols and memoranda;
(C) the Chinese laws and regulations and mandatory standards prescribed by the General Administration of quality supervision, inspection and quarantine requirements;
(D) trade contracts or the quarantine requirements stated in the credit.
Article 43rd feed prior to export, the owner or his agent shall provide the inspection, inspection and quarantine institutions, and provide trade contracts, letters of credit, the registration certificate (copy), ex-factory certificates and other documents. Documents provided by the inspection and quarantine agencies to review meets the requirements of acceptance inspection.
44th after accepting the inspection, the inspection and quarantine agencies to conduct inspection and quarantine in accordance with the following provisions:
(A) certificate of checking: checking documents with the names of the goods, quantity (weight), date of manufacture, batch production, packaging, marking, export compliance Enterprise name or registration number, etc;
(B) labels: labels comply with the requirements;
(C) the organoleptic check: packaging, container is intact, there is no spoilage, with or without carrying harmful organisms, there is no soil, animal carcasses and animal waste.
Article 45th inspection and quarantine agencies to export production enterprise products from different categories in accordance with the relevant inspection and quarantine mode sample,/sampling of voucher issued, send safety and health projects, laboratory testing.
46th article by test quarantine qualified of, test quarantine institutions issued exit goods clearance single or exit goods for card vouchers, and test quarantine certificate, related certificate; test quarantine not qualified of, by effective method processing and again test quarantine qualified of, can according to provides issued related single card, be release; no effective method processing or although by processing again test quarantine still not qualified of, not release, and issued exit goods not qualified notification single.
47th exit port inspection and quarantine agencies in accordance with goods replacement inspect the rules check, concentrate on examining the goods permit are met. Identification of qualified, by origin, inspection and quarantine issued export certificates or electronic transfer of the single issue of the export customs clearance form. Fail to pass the examination, shall not be released.
48th article origin of port inspection and quarantine institutions and exit inspection and quarantine authorities should share information in a timely manner.
Health and safety problems found during the inspection and quarantine process, and shall take appropriate measures and report to AQSIQ.
Section III supervision and management
Achieved registration of the 49th article of export feed production, processing enterprises shall comply with the following requirements:
(A) the effective running the self-test automatic control system.
(B) in accordance with the standards of the importing country or region, or contract calls for production of the exported product.
(C) comply with the relevant provisions on administration of medicines and additives shall not be stored, used in China and importing countries or regions to use drugs and additives.
(D) export packing, loading of the feed containers and means of transport shall conform to the requirements of safety and health. Labels shall conform to the relevant requirements of the importing country or region. Shall be indicated on the packaging or label name or registration number of production enterprises, the product uses.
(E) the establishment of corporate archive, record the name of the raw materials used in the production, quantity (weight) acceptance and its suppliers, raw materials, semi products and finished products inspection automation, inbound, outbound, export, pest control, product recalls and other records be maintained for at least 2 years.
(F) fill in the export of feed regulation manual, recording sampling, inspection, supervision, inspection and quarantine institutions examined the situation as well as official visits abroad, and so on.
Achieved registration of feedstuff storing enterprises shall set up an enterprise archive, record store feed name, the quantity/weight, the owner, in and out, pest control, records kept for at least 2 years.
50th on the area of inspection and quarantine institutions registered with the export manufacturing enterprises to implement daily supervision and management, including:
(A) environmental sanitation;
(B) the pest control measures;
(C) the hazardous substance self-test automatic control effectiveness;
(Iv) changes in raw materials or its suppliers;
(E) packaging, bedding materials and finished products;
(Vi) production equipment, appliances, means of transport, health and safety;
(G) the lots and labeling;
(VIII) other content that relates to health and safety;
(IX) the Handbook of export feed regulatory record.
51st inspection and quarantine institutions for registration of export production enterprises annually, years of qualification in the registration certificate (copy) qualified endorsement for annual review records.
52nd inspection and quarantine agencies to feed export Enterprise (hereinafter referred to as exporters) implementation management. Exporters shall be before the first inspection or inspection to inspection and quarantine agencies provide a photocopy of the record.
Exports and production of the same enterprise without filing.
53rd export enterprises should set up file and accept the verification of inspection and quarantine institutions. Archive should document the export inspection number, name, number of feed (weight), packaging, importing countries or regions, foreign importers, business name and registration number, delivery of the goods customs form and other information, records kept for at least 2 years.
54th inspection and quarantine agency shall establish the export manufacturing enterprises and export enterprises registered credit file, to establish a good record companies and record companies list.
55th exit feed by domestic and international inspection and quarantine authorities detected epidemic diseases, toxic or other hazardous substances exceeding quality problems of health and safety, the inspection and quarantine agencies to verify the situation, out of the strict inspection and quarantine measures.
56th registered exporters Exporting producers and for the record found its production, management of related products that may be contaminated and affect the safety of feed, or their export products in foreign countries suspected of triggering the feed when security incidents shall be reported within 24 hours of the inspection and quarantine institutions, taking control measures to prevent unqualified products continue to the factory. Inspection and quarantine authorities after receiving the report, shall, within 24 hours or escalate to the AQSIQ.
57th registered export enterprises, one of the following situations occurs, by the inspection and Quarantine Bureau to withdraw its registration:
(A) grant registration on the basis of major changes in the objective circumstances, failed to meet registration requirements;
(B) the register contents are changed, the failure to change procedures;
(C) fail to pass the annual examination.
58th under any of the following circumstances, the inspection and Quarantine Bureau according to the request of the interested party or ex officio, may revoke the registration:
(A) the inspection and Quarantine Bureau of personnel who abuse their powers, neglect their duties to grant registration;
(B) beyond the legal authority to grant registration;
(C) the violation of legal procedures to grant registration;
(D) is not eligible or not in compliance with the statutory requirements of the exporting producers granted registration;
(E) the law may revoke the registration of the other cases.
Exporting producers obtained through fraud, bribery or other improper means registered, registration shall be revoked.
59th under any of the following circumstances, the inspection and Quarantine Bureau shall handle the registration cancellation procedures:
(A) the expiry date of the registration is not renewed;
(B) export producing enterprise is terminated according to law;
(C) corporate layoffs, production, closures and other reasons is no longer engaged in the export of feed business;
(D) the registration is revoked, withdrawn or revoked in accordance with law;
(E) the registration item cannot be implemented due to force majeure;
(F) the laws and regulations should cancel the registration under other circumstances.
Fifth chapter of transit inspection and quarantine
60th transport feed transit, carrier or escort shall take the waybill and the certificate issued by the competent authorities in the exporting country or area, to the port of entry inspection and quarantine inspection, and a written submission of transit transport routes.
61st transit transport and packing and loading of the feed container should be in good condition, inspected by the port of entry inspection and quarantine institutions, finding transport or packing materials and containers can cause leakage in the course, carrier or escort should be in accordance with the request of the port inspection and quarantine organizations, taking seal measures; sealing measures cannot be taken, denial of transit.
62nd of output has not been included in the seventh article of the country or region list is allowed to be imported from countries or territories, shall obtain approval from the State administration of quality supervision in order to transit.
63rd transit feed from port of entry inspection and quarantine institutions documents of identification, checking compliance, applied after sealing clearance and notifies the exit port inspection and quarantine authorities, the exit port inspection and quarantine institutions supervise and exit.
The sixth chapter legal liability
64th under any of the following circumstances, the inspection and quarantine authorities in accordance with the State Council on strengthening the supervision and management of food and product safety regulations shall be punished:
(A) the keeping, use or import of or prohibit the use of drugs, additives, and other raw materials;
(B) non-registration of feed production, processing registration of enterprise products posing as export production enterprise product;
(C) the full knowledge of safety problems, undeclared, refusing to comply with their reporting obligations to continue to import and export;
(D) refuses to perform product recall obligations.
65th under any of the following circumstances, the inspection and quarantine authorities in accordance with the People’s Republic of China at the entry and exit animal and plant quarantine regulations fine of 3000 Yuan and 30,000 Yuan:
(A) without the approval of inspection and quarantine institutions without authorization and import, transit feed unloaded from the means of transport or ship the parcels;
(Ii) unauthorized opening packaging of feed in transit, or unauthorized opening, damaging quarantine seal or logo.
66th under any of the following circumstances, criminal responsibility shall be investigated according to law; obviously minor does not constitute an offence or a crime plot need not be given punishment in accordance with law, the inspection and quarantine authorities in accordance with the People’s Republic of China Law on the entry and exit animal and plant quarantine regulations for the implementation of fine of between 50,000 yuan and 20,000 Yuan:
(A) the major epidemic animal or plant;
(B) forging or altering animal and plant quarantine documents, seal, flag and seal.
67th article has any of the following circumstances, has illegally obtained, by the inspection and quarantine authorities fined a maximum of 3 times times the illegal gains, no more than 30,000 yuan; no illegal income, and impose a fine of 10,000 Yuan:
(A) using forged or altered the animal and plant quarantine certificates, seals, insignia, seal;
(B) the exporting country or region using forged or altered and quarantine certificates by the competent departments;
(C) other relevant documents using forged or altered;
(D) refuses to accept the supervision and administration of inspection and quarantine institutions.
68th functionaries of inspection and quarantine institutions, intentionally, favoritism and falsification of test results, or neglects his delayed inspection certificate shall be given administrative sanctions constitutes a crime, criminal responsibility shall be investigated according to law.
The seventh chapter by-laws
69th, the following terms shall have the meanings herein are:
Feed: refers to by planting, and farming, and processing, and making of for animal edible of products and material, including bait with live animal, and feed with (containing bait with) ice fresh frozen animal products and the aquatic products, and processing animal protein and the grease, and pet food and the bite glue, and forage class, and silage material, and feed grain cereal, and bran bran cake meal slag class, and processing plant protein and the plant powder class, and tie feed, and additives pre mixed feed,.
Feed additives: feed processing, manufacture, use, process, add small or minute amounts of substances, including nutritional feed additives, feed additives, and so on.
